A.B., age 83 - Widowed for more than ten years, no children of her own, A.B. made the decision to move from her 3 bedroom home to an assisted living residence. While the sale of the home was being handled by a friend, A.B. confided in her attorney that she was feeling overwhelmed by the details and concerned about all the decision making.
The attorney offered that A.B. could amend her existing trust documents to name a professional trustee who would take over immediately, with all of the distribution provisions remaining the same, just as she and her husband designed it.
The trust was amended, A.B. resigned as trustee of her trust and Marguerite Lorenz accepted the role as the trustee. The move to assisted living was successful and A.B. enjoyed living among caring people until she passed away. The family received all the distributions they were entitled to, per the trust document.
